Motions In The DeLay Case

I have finally obtained copies of the Motion for Expedited Hearing filed by the Republican Party of Texas & Chairwoman Tina Benkiser in the DeLay case before the Fifth Circuit Court of Appeals, as well as the Motion for Partial Stay filed with Judge Sparks at the federal district court level in Austin.
Both are pretty much what I expected.

The Motion To Expedite talks about how much time is needed for the candidate replacement procees, etc., but includes this interesting tidbit:

However, in order to meet those deadlines, RPT and its county committees, which may only call the appropriate meetings in accord with their bylaws, will need at least two weeks to choose its nominee. If that nominee happens to also be someone who is already on the November ballot, it will need another week to nominate a new person to fill that vacancy.

Makes you wonder if the nominee hasn’t already been “decided” but not “selected.” Humm…

When you consider that there are two state reps seeking the position (and one is the favorite son of the Religious Right and the law partner of a county chairman), it is not unreasonable to think that we could see that situation come into being. For that matter, the committee isn’t limited to “declared candidates”, so we could see someone else selected who is on the ballot elsewhere.

    It is called covering the bases — though i believe that it is also being realistic about the chances of one particular state representative from Harris County.
