Amendments To HR 35

Dutton (D-Houston) has a parlimentary inquiry. The Secretary is gavling for order.
There are three amendments before the House right now. SOS says three, with one amendment to an amendment.
Dutton asks what happens if HR 35 fails and the amendments fail.
SOS says the Chair will have to decide to take up another resolution.
Dutton asks for a default position.
Williams asks that to be explained.
Dutton: What I’m asking is if a member were in favor of voting in the traditional fashion (from desk and lighting the board) is that in the amendments to HR 35?
Williams says no
Dutton says so that is not a default position and that if all fail we’d have to have another resolution to elect a speaker.
Williams said yes.
DUtton asks if a default position can still be offered.
Williams tells Dutton if he has an amendment to “get it down here.”
Rep. Hartnett recognized. Comments that we considered a board vote and they are concerned about mechanical malfunctions, etc., but that it is a viable alternative.
If the res goes down, more variations on the theme.
King is recognized for PI: going to have amendments to deal with voting process…could I get a clarification fromt he parlimentarian on ARticle III section 12 which requires a record vote if requested by any three members on any issue before the house and that also we’ve adopted the rules of the 79th as the temporary rules today and that I believe rule 5 section 51 allows for a single member to call for a public record vote on any issue before the house. Is that correct?

King asked to restate question:
Asking for Article III Sec 12 of the constitution to be interpreted where three members of the house asking requires a record vote. Plus, that the temporary rules adopted are the rules of the 79th and that in rule five section51, that requires a record vote if so moved.
SOS says on the amendments, entitled to record vote.
KING asks if amendment for secret ballot can overrule constitution if three members on the secret ballot ask for a public record vote.
Parlimentarian wants restate:
KING: Assuming we passed a secret ballot, is that not overruled by the constitution if three members move for a record vote. In other words, does the constitution not supercede any vote on an amendment?
MY ANALYSIS: NO. It’s been done before. That article says, as I recall, except in case of votes for officers.
