HR 35: Amendment Clarification Fiesta

Point of Clarification by Geren:  Williams asked if secret ballot is an amendment. He says none do.

King has a point of information: A couple of sessions back, when the Senate had a in house voting process to elect a Lt. Governor, that that was a secret ballot at that time, am I correct?

Williams: that is correct.

It’s been suggusted that was later released because the Texas Open Records Act required those votes made public.

If that happened on the senate side, and it will happen here, and we go through the trouble…ultimately the records would be released…is that a possibility.

[NOTE: If they move to destroy the ballots as they did in the 40s, 50s, and 60s, it wouldn't]

Williams says they were released voluntarily.

KING: Was it also subject to an ORR

Williams: Parlimentarian would have to research it. She will do that now.

Swinford: Clarification…we’re going to have two resolutions come to us….the one that we’ve got, if it passed, does it cut the other amendment off?

Williams: no difinitive right for one to be offered over the other.

Williams: they’ve agreed to a coin toss to see which one goes first.

Swinford: Vote on both amendments right?

Williams; Offer it as an amendment to an amendment and a motion to table.

Swinford: One provides for a record vote and the other doesn’t, if one passes and one doesn’t, will it cut the other one off?

Williams: Yes.
