Judge Halts Coal Plant Hearings

State District Judge Stephen Yelenosky today issued a temporary injunction that halts permitting on more than a dozen coal power plants utilities giant TXU plans to build in Central and East Texas.

This means that, in addition to forcing the State Office of Administrative Hearings to reconsider its docket on the cases relating to the plants, tomorrow’s scheduled hearining has been halted, and that Governor Perry’s Executive Order allowing the fast-tracking has been struck down.
Moreover, the judge, in a letter sent to attorneys today, said that he believed that coal plant opponents would prevail in showing that Texas Governor Rick Perry lacked the authority to “fast-track” the permitting process for the plants.

I expect the state to appeal this fairly quickly.
