State’s Proscuting Attorney Will Argue For Reinstatement Of DeLay Indictment

An interesting tidbit from the DMN:
An attorney who represents the state in cases before the Texas Court of Criminal Appeals has joined Travis County prosecutors in asking the court to reverse itself and reinstate an election conspiracy indictment against former House Majority Leader Tom DeLay.
State prosecuting attorney Jeffrey Van Horn said the court’s ruling would affect many areas of criminal law. He said under the ruling, the conspiracy statute will apply only to crimes that have been specifically designated by the Legislature as having a conspiracy element.
