The same issue was brought up against Rep. Pena in the 2004 race.  Pena&#039;s residency was challenged in the same fashion; owns a house in 40 but actually lives in 41. About a week before the election, someone from Austin actually filed a lawsuit to challenge the residency issue.  Obviously it never sticked.</description>
