Medina Attempting To Halt Further Grand Jury Proceedings

With the grand jury that indicted Texas Supreme Court Justice David Medina (only to have that indictment dismissed by a friendly prosecutor) set to meet again this week, the troubled judge’s lawyers are going to court to stop that from happening:
“It’s obviously his grand jury that’s doing this for political purposes, when they know the DA is not going to pursue the indictment. They’re just doing this to be mean,” Yates said.
Tuesday morning, Yates will ask Judge Jim Wallace – the same judge who appointed the jury and was asked by Yates to hold two jurors in contempt of court – to disband the entire grand jury.
“They are obviously biased. They violated the law. How can a grand jury go in and make a decision on if someone else violated the law, when they in fact have?” Yates said.
It’s an accusation the two grand jurors deny.
The grand jury will meet Wednesday, but it was not confirmed if they would discuss the Medina case.
This is a sad, sad, sad saga. The only advantage here is that this will likely become a lightening-rod issue or the 2008 election cycle, especially in Harris County.
So far, in every year in Texas in which Democrats have gained seats, they have been aided by serious GOP scandals. I expect the same will hold true in 2008. This should also give Harris County a boost as well, as Democrats there work to turn that county “blue.”
