Medina Indictments Invalidated…Again
By Vince Leibowitz on Jan 23, 2008 in Texas Judiciary
After Harris County DA Chuck Rosenthal decided not to prosecuted Supreme Court Justice David Medina and his wife connected to the arson at their home, a judge has now invalidated the Medina indictments saying the grand jury’s term was improperly extended:
District Judge Jim Wallace ruled that an order extending the panel’s term was not properly drafted, agreeing with a motion filed by the attorney representing Justice David Medina.
The grand jury’s term was to have ended Nov. 2, but the term was extended to February at the district attorney’s request.
The judge’s decision nullified indictments issued by the grand jury against Medina and his wife, as well as 30 others on unrelated mortgage fraud.
You have got to be kidding. I’d like to see the order to extend the Grand Jury’s term, because it is difficult to believe that the paperwork wasn’t properly completed; grand juries are routinely extended and if it was that hard to screw up the paperwork, we’d have seen this a lot before.
