Bill Would Allow Prison Inmates To Smoke

State Rep. Terri Hodge (D-Dallas) has filed legislation which would allow inmates in Texas prisons to possess and use tobacco products.

The bill is HB 285. Hodge filed a similar bill last session.

Texas was the first state prison system to ban smoking by inmates back in 1994. The federal penal system banned smoking in 2004. The result of the smoking ban–in Texas and elsewhere–is a significant and costly black market for cigarettes in prisons in spite of the fact that possession of tobacco products in a Texas prison is a felony.
