A bill by State Sen. Glen Hegar (R-Katy) would make it illegal for an adult to possess or smoke a burning tobacco product such as cigarettes or cigars in a vehicle if persons under age 16 are present.

The bill, SB 2327, would make violating the proposed law a misdemeanor punishable by a $50 fine.

The legislation would prohibit a law enforcement officer from stopping a vehicle for the sole purpose of determining whether an offense under the proposed law is being committed.
